We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

SECTION 6 – DURATION

On completion of the subscription procedure including the making of the payment, we will provide you access to the purchased Service. You agree and understand that access to the Service may at times be influenced and affected by third parties that we use to provide the Service (web hosting, membership site plugins, etc.). You agree and understand that no breach of contract action may be initiated against InstaGST Tech Solutions when there are reasonable delays in the access of the Service.

We InstaGST Tech Solutions reserves the right to terminate the Service, and or access to certain features of the Service, with or without prior notice to you. We will make reasonable efforts to provide notice but is not required to do so under the terms of this agreement.

The periodicity of the subscription shall depend on the subscription plans opted. For example: If you are paying on a quarterly subscription this allows you access to the Service for 90 days. Failure to pay your quarterly susbcription payment will result in access to the Service being stopped.

For annual subscriptions you will receive 365 days access. You may cancel the automatic renewal of your annual subscription as may be applicable at any time and your access to the Site will end at the end of the current contracted term.

Further we reserve to change the modalities and methodologies of the subscription plans to our sole discretion including on a retrospective basis.

SECTION 7 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order/subscription you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete and accurate purchase and account information for all purchases/subscription made at our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

All intellectual property, including InstaGST Tech Solutions copyrighted materials shall remain the sole property of InstaGST Tech Solutions. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site or Service Content or intellectual property, in whole or in part, without our prior written consent. We reserve the right to immediately remove you from the Service, without refund, if you are caught violating this intellectual property policy. However sharing the links of our website in the screens which allows the same is a permitted course of action and hence the users may share such links as permitted.

In no case shall InstaGST Tech Solutions, our owners, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

This Agreement constitutes the entire agreement between you and InstaGST Tech solutions pertaining to the Site and Service and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by InstaGST Tech solutions shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by InstaGST Tech solutions.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 20 – ARBITRATION

All disputes shall be resolved by mutual consultation. If any disputes cannot be resolved, the same shall be decided by sole arbitrator sitting in Bangalore according to Indian Arbitration and Conciliation Act 1996 and the applicable laws of the Republic of India. In the case of failure of the arbitration, courts of Bangalore alone shall have the jurisdiction to take up the disputes.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India and jurisdiction of Bangalore, Karnataka.

SECTION 24 – RETURNS

Our policy lasts 30 days in case of product purchased. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

Further in case of subscription charges paid, we do not offer any refund. However on a case to case basis we might consider extension of the subscription period as a gesture for being our customer, if circumstances warrant so, but the same would be subject to our sole discretion.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Additional non-returnable items:

• Gift cards
• Downloadable software products

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

• There are certain situations where only partial refunds are granted: (if applicable)
• Book with obvious signs of use
• CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened.
• Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
• Any item that is returned more than 30 days after delivery

SECTION 25 – REFUNDS

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain number of days.

SECTION 26 – LATE OR MISSING REFUNDS

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

If you’ve done all of this and you still have not received your refund yet, please contact us at subscription@instagst.com.

SECTION 27 – SALE ITEMS

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

SECTION 28 – EXCHANGES

We only replace items if they are defective or damaged.  If you need to exchange it for the same item, send us an email at subscription@instagst.com and send your item to: F. No.1042, PSR, No. 125, Hosakerehalli Cross, Banashankari 3rd Stage, Bangalore – 560085.

SECTION 29 – GIFTS

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

SECTION 30 – SHIPPING

To return your product, you should mail your product to: F. No.1042, PSR, No. 125, Hosakerehalli Cross, Banashankari 3rd Stage, Bangalore – 560085.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over INR 1,000/-, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
